PART-I: OUR GLOBAL BUSINESS REGISTRATION FILING EXPERIENCE

We are working on filing our company in an Asian country and tried to follow all the rules outlined for such registration process. The company hired for this process, as this is the norm suggested nowadays to go through such processes though there is a push for direct streamlined online processes across board in the country, were given all necessary details and payments in the first week of March. 

We also added additional documents as and when we were requested  We also are trying to file three trademark applications after the completion of the process, which has not happened yet either. There were several road blocks brought up during this process with one major one being the PAN card of one of the directors not matching with the PAN database, though three of the related issued identity records matched with each other. 

It made us wonder how the database which is used in the first place would mismatch with the physical document provided through this database. After repeated contacts, all of a sudden after trying back and forth almost a dozen times or so, one specific form that was holding us back went through as per information shared by the third-party company, which is looking into this registration process. 

Is it the end of the story?
Then, after this delay, again all of a sudden, we were asked to produce apostille documents for one of the directors within a short period of time by the government agency when there was commotion and unrest in the city where our primary location of residence is. Added to it, with lock down due to global pandemic, it further complicated the situation. By the way, we had offered to produce the same documents upfront to the third-party processor, a couple of months prior to this initiation by the government agency. 

The level of complication heightened when the documents to be apostilled did not reach us until after three days after the letter from the government agency came through, though the document turned out to be the same as what was submitted before.

Anyways, we have done the needful and have submitted the documents that needs to be apostilled to the agency in-charge for this purpose after getting those documents notarized as per the requirements. We will produce the same as soon as we receive the apostilled documents to complete this process.

Stay tuned - Story to be cont'd ..... What happened next? 
  • Did the apostille documents come on time? 
  • Was there any issue with the notary signature?
  • What happened to the shipping package? Was it picked up and delivered on time?
Again, more twists and turns in this story. Funny, but a real one.

1. May I know what is the normal time for the Ministry to get back on an application? - It depends on Ministry (state wise), approx 7 working days

2. I will look through those documents for the trademark applications and will get back to you. If you don't mind, could you send another email with all the three documents of the latest version that you have for us to be on the same page? - the documents will remain same

3. May I know what made the application go through this time, which is important for me to know considering the unnecessary delay and anxiety that came with this delay in process for no fault of mine? - I tried the process again, nothing new was done

There were all kinds of delays last week. However, in my case, it appeared that no one from the shipping company went to pick up the package for at least a couple of days if the packet was really ready for pick up as per the officials whom I spoke to over the phone, though I paid for one of the faster ways to ship the package and receive the return package. Then, I had to find the company Chicago hub's contact number and got hold of someone, who helped in sending a driver to pick it up on Wednesday. 

I also found out that the government agency does not keep track whether the packages get removed or not from their end, and the only information that they mentioned was the package was dropped in the mail box.  That entire mishap resulted in further delay by three more days. Furthermore, the package was supposed to be delivered on Thursday, but for some reasons, it got struck at a local center that evening on Thursday and did not get delivered until Friday. Moreover, if the government officials had informed me about the issue with the notary signature when I had called on Monday, I could have gone through the process again on the same day to resubmit the forms and we would have received the package by the end of the week. Anyways, I don't have control over either their actions or any other involved parties actions. I did my best that I could to move this process along.

May I know what I need to do with the apostille documents once received?

By the way, ####, #### had sent a screenshot of the trademark search results, which I had requested then to confirm that those names are available for trademark registration. I will look for the same email. If possible, please check with ##### on this one and if you could track those images, resend it to me. This is an official document providing a timestamp confirming the availability of the name then.

Hello Mr Srikanth,

Here are the answers to your following queries :

1) Stamp duty cost will only change if the initial capital is more than Rs 1,00,000. Below Rs 1,00,000 will not make any changes in stamp duty charges.
2) As per out telephonic conversion I have the checked the following name (VAL-U-PRO CONSULTING GROUP;Amazebaba and its affiliates;AAAAA mega ecosystem)
for trademark application under class 35 , and I couldn't find anyone having the same name.
3) In addition , IMESSENGER under class 38 (telecommunication ) was also not found matching with anyone.
